905.1 - Community Use of School District Facilities & Equipment

School district facilities and equipment will be made available to local nonprofit entities which promote cultural, educational, civic, community, or recreational activities.  "Entity(ies)" will include organizations, groups and individuals and their agents.  Such use will be permitted only when the use does not interfere with or disrupt the education program or a school-related activity, the use is consistent with state law, and will end no later than midnight.  It is within the discretion of the board to allow for-profit entities to use school district facilities and equipment.  The board reserves the right to deny use of the facilities and equipment to an entity.  It is within the discretion of the superintendent to allow use of school district facilities and equipment on Sundays and waive or modify rental and personnel fees for events and activities that are in the interest of students and the public.

Requests for use of school facilities for activities other than educational purpose or intent of the district (which shall always have precedence) shall receive priority scheduling based on the following classifications based on a first come first served basis:

1. Class A: Meetings or activities for students, parents, and staff that are identified as tax exempt organizations which are affiliated with district programs, such as:

        ○ Parent Teacher Organizations

        ○ Booster Clubs

        ○ Local meetings of the Clarinda Education Association

        ○ Chamber of Commerce

        ○ Local Foundations

2. Class B: Programs or training activities sponsored by tax supported organizations, such as:

        ○ Lied Center

        ○ University and Community College educational programs

        ○ AEA educational activities

        ○ Emergency management programs

        ○ Government agencies (city, county, state, etc.)

        ○ Armed forces (other than recruitment)

        ○ Generally, public agencies and programs that do not charge an admission

3. Class C: Educational and recreational programs which are sponsored by tax exempt organizations, such as:

        ○ Staff recreational programs

        ○ Church programs

        ○ Civic organizations

        ○ Political meetings

        ○ Government sponsored meetings which the public is invited to attend

4. Class D: Fundraising activities and nonprofit meetings and activities sponsored by commercial groups and other non-tax exempt entities

 

Fee Classification:

The school board establishes the rental and personnel fees for use of district facilities. The following classifications shall be used to determine the appropriate fee:

  1. Groups classified as Class A are exempt from all rental fees. They are also exempt from personnel fees for events that are scheduled within normal hours of operation. They shall be charged for personnel fees for events that occur outside normal hours of operation.
     
  2. Groups classified as Class B are exempt from all rental fees but will be charged for necessary personnel fees.
     
  3. Groups classified as Class C shall be charged rental and personnel fees.
     
  4. Groups classified as Class D shall be charged rental and personnel fees.

 

Rental fees consist of the use of school facilities and equipment. Personnel fees consist of associated costs for school personnel as a result of facility use. All forms and associated fees shall be submitted to the High School Activity Director’s Office 24 hours in advance of the scheduled activity.

Entities that wish to use school district facilities or equipment must apply at the High School Activity Director’s Office. It is the responsibility of the administration to determine whether the school district facility or equipment requested is available and whether the application for use meets board policy and administrative regulations. It is the responsibility of the high school activity director to provide application forms, obtain proof of insurance, and draw up the contract for use of school district facilities and equipment.

Use of school district facilities and equipment by entities will be supervised by a school district employee unless special arrangements are made in advance with the superintendent. The school district employee will not accept a fee from the entity using school district facilities and equipment. If appropriate, the school district employee may be paid by the school district.

Entities that use school district buildings, or equipment, or sites must leave the building or site in the same condition it was in prior to its use. Inappropriate use of school district facilities and equipment may result in additional fees charged to, or the inability of, the entity to use school district facilities or equipment in the future.

  2. The use of tobacco or consumption of alcohol is prohibited on school property.  Food and beverages are not allowed in certain areas of the building.  All food and beverage sales shall be approved prior to signing the agreement.
  3. Weapons of any sort are prohibited on school property.  
  4. The School administration has the right to refuse or revoke the reservation of the building.

CLARINDA COMMUNITY SCHOOL DISTRICT
FACILITY USE AGREEMENT

 

The undersigned (hereafter referred to as User) agrees:

  1. The User has received a copy of the Clarinda Community School District’s (hereafter District) policies for use of the District’s facilities (reference board policy 905.1).
  2. The User has read, understands, and agrees to abide by the rules for use of the District’s facilities.
  3. The User agrees if the User fails to abide by the District’s policies for use of the District’s facilities, the User will be responsible for any damage to the District’s facilities, property, and/or contents.
  4. The User agrees the User violates the rules of use of the District’s facilities and/or the District’s facility use agreement, the User’s use of the District’s facilities may be ended immediately and the User may not be permitted to use the District’s facilities in the future.

To the fullest extent permitted by law, the User agrees to protect, defend, indemnify, and hold harmless the District and its officers, employees, or agents from any and all claims, damages, losses, and expenses, including, but not limited to, attorney fees, occasioned by, arising out of, or resulting from any accident or other occurrence causing or inflicting injury or damage to any person or property, happening or done in, upon, or about the District’s premises, or due directly or indirectly to the use or occupancy of the District’s premises or any part thereof by the User or any person claiming through or under the User.

CLARINDA COMMUNITY SCHOOL DISTRICT
USE OF SCHOOL DISTRICT FACILITIES AND EQUIPMENT
INDEMNITY AND LIABILITY INSURANCE AGREEMENT

 

The undersigned, hereafter referred to as “Entity,” states it will hold the Clarinda Community School District, hereafter referred to as “school district,” harmless from any and all damages and claims that may arise by reason of any negligence on the part of the entity in the use of any facilities or equipment owned by the school district.  In case any action is brought therefore against the school district or any of its officers, employees, or agents, the entity will assume full responsibility for the legal defense thereof, and upon its failure to do so on proper notice, the school district reserves the right to defend such action and to charge all costs, including attorney fees, to the entity.

The entity agrees to furnish and maintain during the usage of the facilities or equipment owned by the school district such bodily injury and property damage liability insurance that will protect the entity and the school district from claims or damages for personal injury, including accidental death, and from claims for property damages which may arise from the entity’s use of the school district’s facilities or equipment whether such operations be by the entity or by anyone directly or indirectly employed by the entity.  Such insurance shall include the school district as an additional named insured on any insurance policy carried by the entity to provide coverage for the liabilities described above.

The entity will furnish the school district with a certificate of insurance acceptable to the school district’s insurance carrier before the facilities use agreement is executed and approved.

905.1R2 - Use of School District Facilities & Sites and Fee Schedule

The following Fee Schedule shall serve as a guide to determine the appropriate fee for use of district facilities.  The superintendent has the discretion to waive, set, and access fees for requests that do not fall into a specific class.

 

Class A
Groups classified as Class A are exempt from all rental fees.  They are also exempt from personnel fees for events that are scheduled within normal hours of operation.  They shall be charged for personnel fees for events that occur outside normal hours of operation. The Superintendent will determine the rate of additional charges if necessary.

 

Class B
Groups classified as Class B are exempt from all rental fees but will be charged for necessary personnel fees.  The Superintendent will determine the rate of additional charges if necessary.

 

Class C
Groups classified as Class C shall be charged rental and personnel fees.  The Superintendent will determine the rate of additional charges if necessary.

 

Class D
Groups classified as Class D shall be charged rental and personnel fees.  The Superintendent will determine the rate of additional charges if necessary.

 

Personnel fees shall be a minimum of two (2) hours for each event.

905.2 - Tobacco/Nicotine-Free Environment

905.2 - Tobacco/Nicotine-Free Environment

School district facilities and grounds, including school vehicles, are off limits for tobacco or nicotine use, including the use of look-a-likes where the original would include tobacco or nicotine.  This requirement extends to students, employees and visitors.  This policy applies at all times, including school-sponsored and nonschool-sponsored events.  Persons failing to abide by this request are required to extinguish their smoking material, dispose of the tobacco, nicotine or other product or leave the school district premises immediately.  It is the responsibility of the administration to enforce this policy.

905.3 - Weapons in the School District

905.3 - Weapons in the School District

The board believes weapons, other dangerous objects and look-a-likes in school district facilities and at school district-approved events cause material and substantial disruption to the school environment or present a threat to the health and safety of students, employees and visitors on the school district premises or property within the jurisdiction of the school district.

All weapons, dangerous objects and look-a-likes are prohibited to be carried, possessed, transported or otherwise stored on school district property and to school district-approved events.  Exceptions to this policy include weapons carried by the following individuals in performance of their official duties:

  • law enforcement;
  • military personnel;
  • corrections officers;
  • individuals approved in writing by the Superintendent, and;
  • students and individuals approved in writing by the Superintendent who are actively engaging in a school district approved firearms safety course, hunter education course or shooting sports activity.

Individuals found to be in violation of this district policy will be required to immediately remove the weapon, dangerous object or look-a-likes from the school district property or event.  Students found to be in violation of this policy or any other board policies related to weapons will be subject to disciplinary proceedings.
